TariffBase Terms of Use

These Terms of Use ("Terms") govern your access to and use of the TariffBase website and related services (collectively, the "Service"). The Service is operated by Zhu Consulting ("Operator", "we", "us", or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service.
The Service is primarily intended for business users (including SMEs). If you use the Service as a consumer, mandatory consumer protection rules may apply in your jurisdiction.
3. Account registration and security
To access certain features, you must create an account. You agree to:
- provide accurate and current account information;
- keep your login credentials confidential; and
- promptly notify us of any unauthorized access or suspected security issue.
You are responsible for all activity that occurs under your account.
4. Service description
TariffBase provides tariff intelligence tools and content, which may include:
- Tariff Search: customs duty lookup results (VAT/GST excluded) for supported markets based on destination, origin, and product code, including certain special measures where applicable.
- Tariff Schedule: browsing of tariff schedules through a standardized interface.
- Smart HS Code Finder: AI-assisted HS classification support and decision-support reports.
- Tariff Intelligence: curated tariff-related news, daily summaries, trackers, and reports/insights.
- Tariff API: programmatic access to certain data and results, where available.
We may update, modify, add, or remove features at any time. We do not guarantee that any particular feature will remain available.
5. No legal, customs, tax, or professional advice
The Service is provided for informational and decision-support purposes only. It does not constitute legal advice, customs brokerage services, tax advice, or professional consulting.
You are solely responsible for:
- verifying classifications, rates, measure applicability, and effective dates;
- complying with customs, trade, and related laws; and
- decisions and actions you take based on the Service.
HS Code Finder disclaimer: HS classification outputs (including confidence indicators, suggested codes, or reports) are not a legal determination and may be incomplete or incorrect depending on product facts and applicable rules. You should verify with qualified professionals and/or relevant authorities where appropriate.
6. Data sources, updates, and accuracy
We source data from official publications and other credible sources and apply quality controls, including manual/human validation checks. However, tariffs and measures can change rapidly, and results may depend on facts not captured by your input (e.g., composition, end use, origin rules, documentation, exclusions, legal notes).
Accordingly, we do not guarantee that any content, data, or output is error-free, complete, or current at all times.
7. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for unlawful purposes or in violation of applicable laws (including trade, export control, and sanctions laws);
- attempt to gain unauthorized access to systems, accounts, data, or networks;
- interfere with or disrupt the Service (including scraping, crawling, or excessive automated requests);
- reverse engineer, decompile, or attempt to extract source code or underlying models except where prohibited by law;
- resell, sublicense, redistribute, or make the Service available to third parties except as expressly permitted in writing by us;
- upload or transmit malware, harmful code, or exploit vulnerabilities; or
- misrepresent your identity or affiliation.
We may suspend or terminate access for suspected misuse or violations.
8. Subscriptions, free trial, billing, and cancellation
8.1 Plans and pricing
Some features require a paid subscription. Plan details (features, pricing, billing periods) are displayed on the TariffBase pricing/checkout pages and may change over time.
8.2 Free trial
We may offer a 10-day free trial to eligible users. Trial eligibility and limitations may vary. If you do not cancel before the trial ends, your subscription will start and you will be charged according to the selected plan.
8.3 Automatic renewal
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
8.4 Cancellation
You can cancel at any time via your account settings or by contacting us. Cancellation stops future renewals. Unless required by law, you will retain access until the end of the current paid period, and then access will end.
8.5 No refunds
All fees are non-refundable and non-creditable, including for partial use, unused time, downgrades, or cancellations, except where required by mandatory law.
8.6 Annual billing discount (if offered)
If we offer annual billing with a discount (e.g., 20% off compared to monthly), the discount applies only while the annual plan is active and subject to the terms shown at purchase.
8.7 Payment processing
Payments may be processed by third-party payment providers. Your use of those services is subject to their terms and privacy policies.
9. Seats, credential sharing, and company accounts
Unless explicitly included in your plan or agreed in writing:
- subscriptions are intended for use by the account holder (single-user access);
- you must not share credentials or allow others to access the Service via your account.
If you need multi-user or company-wide access, seat-based billing, or team management features, you may contact us for a custom arrangement, which must be confirmed in a written agreement or order form.
10. API terms (Tariff API)
If you access the TariffBase API:
- you must keep API keys secure and confidential;
- you may use the API only for your internal business purposes unless we agree otherwise in writing;
- you must comply with any published rate limits, documentation, and usage policies;
- you must not use the API to replicate or redistribute our datasets/results at scale, or to build a competing product.
We may monitor API usage for security, abuse prevention, billing, and performance, and may suspend/revoke API access for violations or security risks.
11. Intellectual property
The Service, including software, design, text, databases, compilations, reports, trademarks, and logos, is owned by the Operator or its licensors and protected by applicable intellectual property laws.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription term.
12. Third-party content and links
The Service may include or reference third-party content (e.g., news sources, reports, links, citations). We do not control third-party content and are not responsible for it. Your use of third-party sites is at your own risk and subject to their terms.
13. Privacy, cookies, and communications
Your use of the Service is governed by our Privacy Policy and any Cookie Policy, which describe how we collect and use personal data under Swiss data protection law and, where applicable, the EU GDPR.
We may send:
- service communications (e.g., security, billing, product/service notices); and
- marketing communications (e.g., newsletters) where you opt in or where permitted by law.
You can unsubscribe from marketing emails via the link in those messages.
14. Suspension and termination
We may suspend or terminate your access immediately if:
- you materially breach these Terms;
- your use poses a security, legal, or operational risk; or
- we are required to do so by law.
You may stop using the Service at any time. If we terminate for cause, no refunds are provided except where required by law.
15. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- the Service will be uninterrupted or error-free;
- outputs will be accurate, complete, or suitable for your specific use; or
- defects will be corrected.
16. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, business, goodwill, or reputation.
- Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the total amounts you paid to us for the Service in the 12 months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations. In that case, limitations apply to the fullest extent permitted.
17. Indemnity
You agree to indemnify and hold harmless the Operator and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- your use of the Service;
- your violation of these Terms; or
- your violation of applicable laws or third-party rights.
18. Changes to the Service or Terms
We may update the Service and these Terms from time to time. We will post updated Terms on the website and update the Effective date. If changes are material, we may provide additional notice (e.g., email or in-app notice).
Your continued use after the effective date of changes constitutes acceptance of the updated Terms.
19. Governing law and jurisdiction
These Terms are governed by the substantive laws of Switzerland, without regard to conflict-of-law rules.
Exclusive jurisdiction: The courts of SWITZERLAND shall have exclusive jurisdiction, subject to any mandatory legal provisions that apply.
20. General terms
- Severability: If any provision is held invalid or unenforceable, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, reorganization, or asset sale.
- Entire agreement: These Terms and referenced policies constitute the entire agreement regarding the Service.
